TERMS OF SERVICE

  1. Agreement

These Terms of Service govern the use of this website and purchases from Arabella Fashion and Clothes Designing - L.L.C. O.P.C. (“Arabella”, “we”, “us” or “our”).

By using the website, creating an account or placing an order, the customer agrees to these Terms and the policies published on the website.

  1. Customer Information and Accounts

The customer must be legally capable of entering into a purchase transaction and must provide accurate and current contact, payment and delivery information.

The customer is responsible for keeping account login details secure and for activity conducted through the customer’s account.

  1. Products

We take reasonable steps to describe and display our products accurately.

Minor differences caused by photography, lighting or screen settings do not constitute misdescription. A product is misdescribed where it materially differs from the confirmed colour, design, fabric type, quantity or other essential product description.

Product availability is subject to stock. Customers should review the stated measurements, width, composition, care instructions and other product information before placing an order.

  1. Orders

Submitting an order is an offer to purchase the selected products. An order is subject to successful payment, stock availability and confirmation by us.

We may cancel an order before dispatch where:

  • A product is unavailable;

  • Payment is unsuccessful;

  • Required information is incomplete or inaccurate;

  • Fraud or unauthorised activity is reasonably suspected; or

  • There is an obvious pricing or product-information error.

Any amount already paid for a cancelled order will be refunded.

  1. Prices and Payment

Prices are displayed in UAE dirhams. Applicable taxes, delivery charges and discounts will be shown before the customer confirms the order.

Payments are completed through Shopify Checkout using Stripe or another payment method displayed at checkout. Payment may be subject to verification by Shopify, Stripe, the card issuer or another payment provider.

We do not directly store complete payment-card details.

  1. Cut Fabric and Custom Orders

The customer is responsible for confirming the fabric, colour, design, length, dimensions and quantity before placing an order.

Cancellation or amendment may not be possible after cutting or custom preparation has started.

Returns, exchanges and refunds for cut fabric and custom orders are governed by the Returns, Exchanges and Refunds Policy. Rights concerning damaged, defective, incorrect or materially misdescribed products are not affected.

  1. Shipping and Delivery

Shipping and delivery are governed by the Shipping and Delivery Policy published on the website.

The customer is responsible for providing accurate delivery information and for being available to receive the order.

Delivery dates are estimates and may be affected by the destination, public holidays, courier delays, weather or circumstances outside our reasonable control.

  1. Returns, Exchanges and Refunds

Returns, exchanges and refunds are governed by the Returns, Exchanges and Refunds Policy published on the website. That Policy forms part of these Terms.

Nothing in these Terms limits a mandatory consumer right under UAE law.

  1. Use of the Website

The website may be used only for lawful purposes.

Users must not:

  • Use the website for fraudulent, unlawful or misleading activity;

  • Interfere with its operation or security;

  • Introduce malicious code or harmful technology;

  • Attempt to gain unauthorised access to any account, system or data;

  • Collect personal information about other users;

  • Copy or scrape website content for commercial use without permission; or

  • Infringe the rights of Arabella or another person.

We may restrict access where misuse, fraud or a security risk is reasonably suspected.

  1. Website Content

Content created by or for Arabella, including original photographs, text, graphics and design elements, may not be copied, republished or used commercially without our permission, except where permitted by law.

Content belonging to Shopify or another third party remains the property of its respective owner.

  1. Shopify and Other Service Providers

This store is hosted by Shopify. Arabella is the seller of the products, and every contract of sale is between Arabella and the customer. Shopify is not the seller and is not responsible for the products, order fulfilment, customer service, returns or refunds.

Shopify provides the website platform, hosting, checkout, account, order-management and related services. Customers may also use Shopify services such as Shop or Shop Pay, which are governed by Shopify’s applicable terms and privacy policies.

Payments may be processed by Stripe or another payment provider available through Shopify Checkout.

The website may also use delivery, communications, analytics and other services supplied by third parties. Use of a third party’s separate service may be subject to that provider’s terms.

  1. Privacy

Personal information is processed in accordance with the Privacy Policy published on the website.

Shopify, Stripe and other service providers may separately process personal information in accordance with their own privacy policies.

  1. Website Availability and Errors

The website may occasionally be unavailable because of maintenance, updates, technical faults or circumstances outside our reasonable control.

We may correct an obvious typographical, technical, pricing or product-information error. If an error materially affects an order, the customer may confirm the corrected order or receive a refund.

  1. Liability

Nothing in these Terms excludes liability for fraud, wilful misconduct, breach of a mandatory consumer right or any liability that cannot lawfully be excluded.

To the extent permitted by law, Arabella is not liable for indirect or consequential loss arising from use of the website or from a delay caused by circumstances outside our reasonable control.

  1. Changes to These Terms

We may update these Terms to reflect changes to our website, services, business practices or legal obligations.

The revised Terms will be published on the website with an updated date. The Terms in effect when an order is placed will apply to that order unless a change is required by law.

  1. Governing Law and Jurisdiction

These Terms, the website and all sales are governed by the laws of the United Arab Emirates.

The competent courts of Abu Dhabi, United Arab Emirates, have exclusive jurisdiction over any dispute arising from or relating to the website, an order or a sale.
